Title: Circuit breaker question

If I have a 240 vac 40 amp load can I protect it with a single pole 40 amp breaker on one leg of the 240 vac?

Ponder the outcome of a ground fault on the unfused leg. And then hire an electrician..

If using the common 120-0-120 North American split-phase power, you must use ganged two-pole circuit breakers on 240V circuits.

No. You need a two pole ganged breaker as mentioned and #8 awg wire. If you use 8/2 with ground, mark the white lead with black tape on both ends.

Ovens/Ranges/Dryers now require a GFCI breaker.

You have to have two adjacent slots free to get 240 out of an American panel.
