Ebay use "take action" button

Completely agree here unless the seller can get it to you within your original claim window. Sellers can give you a sob story which is purely a delaying tactic in the hope you will let that window close. Once that happens, they can ignore you and you've lost your money.

Absolutely. I have done this when an item hadn't turned up and the seller sent another (which arrived in time) and then the original turned up 2 months later, which I kept as a spare (it was a good price). They appreciated my offer to pay - and the funds which followed.

Yes. They give those dates for a reason.

If i take money back is not right since he shipped.

You should still file a claim, you can close it when the replacement arrives. It's a common tactic to tell you they shipped another one so that you wait until after the time limit expires.

.... and if one does arrive after you get a refund, you can always pay them.
