Title: Ebay use "take action" button

So i havent received my item, tomorrow is day 44.
No it is not from china, else i knew it has more delay.

What will happen if i press the take action button ?
Or do i need to go to the paypal site to get a refund ?
How does it works ?

I take my money back, suppose it being delivered next week, i can still pay the seller.
If i dont take my money back, 45 days have passed and i have nothing.

You used the "take action" button before ?

You should be able to contact the seller directly from your purchase history, just send him a quick message that the item hasn't arrived yet. Has happened a few times to me, in most cases the seller just refunded me completely without asking any question.

By "take action button" do you mean the resolution center?
If so, you have 30 days after it should have arrived to use it.
Usually I first send an eBay-message to the seller and if it's not
solved within a handfull of days, then I use the resolution center.

Well, this seller have asked me to drop the case then he can send the item.
He sended again, and still waiting, only with 45 days passed i cant get money back, i dont trust this seller anymore.
I,m not crazy to drop the case before i get my item.

Ask the seller to update your "Orders" list, including
estimated delivery (and tracking number). If that's not done,
I guess you could wait until a few days before the 30 day
deadline and then use the resolution center. As a general
rule, I always ask for a refund to avoid this problem.

With 30 days after it not arrived my paypal 45 days are over.
That is my point why i make this topic, i,m not sure if i can get my money back if i wait past 45 days.

Yes file a claim, you can always close it as resolved if your item turns up.

Whenever an item does not arrive until the deadline shown by ebay I file a claim immediatly.

Never accept for the seller to resend the item - it will be a huge risk on your side. Ask for a full refund and order again if you want to.

Also, if an item arrives the day aftwr the refund and you feel it was not the sellers fault, you can be the nice guy and pay him again.

But always take action on the dates ebay suggests.

If I am feeling generous, I will wait until about 3 days before my window closes and raise a case.

Completely agree here unless the seller can get it to you within your original claim window.  Sellers can give you a sob story which is purely a delaying tactic in the hope you will let that window close.  Once that happens, they can ignore you and you've lost your money.

Absolutely.  I have done this when an item hadn't turned up and the seller sent another (which arrived in time) and then the original turned up 2 months later, which I kept as a spare (it was a good price).  They appreciated my offer to pay - and the funds which followed.

Yes.  They give those dates for a reason.

He shipped another, should wait and believe it is really shipped.
If i take money back is not right since he shipped.

Next time i know to take instant money back.

You should still file a claim, you can close it when the replacement arrives. It's a common tactic to tell you they shipped another one so that you wait until after the time limit expires.

He told you he shipped another... but did he actually ship one?  (A supplied tracking number isn't proof the item being tracked is yours!)

.... and if one does arrive after you get a refund, you can always pay them.

You have 180 days to file a claim for item not received with PayPal.

Don't be Naive.

EBay is CHOCK FULL OF SCAMMERS.

The legitimate sellers will have no issue refunding or replacing and make no issue of it.

But it is your responsibility, your 'duty' to immediately communicate issues to the seller through ebay messaging system and to take action exactly when the ebay 'claim window' opens.

Due diligence is your responsibility, and Scammers rely on the exact same hesitation that you have exhibited, to leverage the scam.

I'm guessing you are  / may be about to learn a hard lesson, through the protracted dispute resolution process, and your seller feedback should also be honest and reflect the events. If the seller scammed, you should be specific in your feedback as a warning to others.
