You can probably try the same as above: sue them for the annoyance - if you can prove it's really an annoyance, which may not be that easy to do once some laws have changed - but not for violating your property.
As to exactly how much height above ground you "own" (that is considered part of your property), I guess it depends on local regulations, and I admit I have no clue. Is it the top of your tallest tree if you have trees? Is it the top of your roof? Dunno.

I don't think you own the airspace in your own living room! And, the airlines seem to be immune from noise complaints now. And the delivery truck is an annoyance enough.
If they fly over my home, I'm going to fly some kites. It'll be like fishing, for drones, and maybe snag a pizza delivery. >:D

Ok guys the reason politics is banned here is because the more educated one is, the less relevant their opinion is on politics. "Smart with electronics" and "collegel educated" does not have anything to do with "common sense" so we really have no business discussing such matters. Also since half the planet has gone blind on ORANGE MAN BAD pills, this one needs to be brushed aside ;)
Let's get back to this FAA stuff :-DD

If aeromodelling as a hobby is destroyed in the interests of commercial profit making delivery operations, I could see a lot of former modellers moving over to flying scale model barrage balloons ... :-DD
For some good pictures of barrage balloons:

For those interested in how effective barrage balloons were over London:
http://www.bbrclub.org/Barrage%20Balloon%20Cable%20Collisions%20with%20Aircraft%20in%20WWII.htm
Short answer: they brought down many more friendly aircraft than hostile.
Long answer: not surprising because there were far more friendly aircraft than hostile operating over London and the numbers don't tell you anything about their effectiveness as a deterrence. And talking to "a former member of the Luftwaffe and he told me that it was their greatest fear as they got nearer to the target".
