Which begs the question: Why is there a legal notice on U.S. tobacco sales in a well-known German interconnect manufacturer's terms of use for 3D CAD models?? :-\

As if vanilla legalese wasn't sufficiently convoluted to begin with... |O

As if vanilla legalese wasn't sufficiently convoluted to begin with... |O

legal team had too much socially responsibly harvested coffee perhaps
or ate too many dolphin-safe tuna sandwiches
or it's simply a left over from a copy-and-paste job


   If three 100  Ohm resistors are connected in parallel, and in series with a 200 Ohm resistor, how many resistors do you have?

The way the American legal system works this does not surprise me, after all, we have parents taking games manufacturers to court after their children grab a gun and run around shooting people. Here's a rough guess why that clause may be in there:

1) CAD Software is used at some point to design stand housing packets of cigarettes.

2) Someone under 18 buys pack of cigarettes.

3) Later that child gets cancer.

4) Parents of child sues the retailer, the tobacco manufacturer, the company who printed the packs, the manufacturer of the stand the cigarette packs were on and the manufacturer of the CAD package used to design the stand.

I've worked with lawyers, this is now unfortunately quite common.

That's pretty extreme. I guess at the end of the day, it's all about money.  :--
I'm going to sue metal manufacturing companies for making swing sets that will eventually (possibly) cause injuries now!  :box:

The citry that built the road that led to the stand,
the truck manufacturer the pack were transported into,
the fuel company for providing fuel for the truck,
the tires installed on the whhels of the truck,
the clothes manufactured the truck driver was wearing
the electric company for powering the stand the cigs were sold,
the electrician that installed the light bulbs ... and it goes on...and on...and on....

Digikey doesn't have a tabacco section ( or pullution or wildlife protection or guns or speeding or driving drunk) so it must be translation of the American Law as understood by a German attorney with English skills not quite as good as he/she thinks it is.

When in doubt, throw in and the kitchen sink. And some ferrite beads.  bzzzt

Go back a decade or so and a company called The SCO Group were suing Linux users because, in their view, they held the copyright on certain aspects in the Linux kernel. Not the distributions or the programmers behind them, the users. We also have the manufacturers of computer games that I mentioned previously but if you really want silly legal cases try the following:

1) a 59-year-old woman is suing her company’s landlord after she was badly injured in a vicious attack by a seagull. She was left injured by the bird’s dive-bombing and now suing the owner of the office building where she works, claiming it did not take sufficient care for her safety.

2) A 26-year-old pimp from Portland, Oreogan sued Nike for £60million claiming the shoe manufacturer is partially responsible for a brutal beating that helped net him a 100-year prison sentence. Sirgiorgiro Clardy claims Nike should have placed a label in his Nike Air Jordan shoes warning consumers that they could be used as a dangerous weapon. He was wearing a pair when he repeatedly stomped the face of a man who was trying to leave a Portland hotel without paying Clardy’s prostitute in June 2012.

3) A Woman wanted to enter a nightclub through its toilet window so she would not have to pay the $3.50 entrance fee. As a result, she fell down the floor and knocked out her two front teeth. She was awarded $12,000 and got all her dental expenses paid.

Sign a contract in 1900 and it would have been on a single sheet of paper, sign a contract now and you have countless pages of small print thanks to cases like this.

The fact is, the US legal system is largely inaccessible to almost all people, dangerously so, because those with lots of money get away with anything and everything fairly consistently, and almost no lawyers take cases on contingencies, (you pay them if you win). To give one example, medical malpractice cases are fewer and malpractice insurance and payouts are a lower percentage of health care costs, than they have ever been at any previous time in history. Nonetheless the right wing tries to blame insanely high US healthcare and drug costs on them.

They forgot to add the California Prop 65 label for possible hazardous materials in the 3D files.

Bingo.  I once had a colleague who had to write a lengthy monthly status report that he was sure no one read.  He inserted the sentence "I'll buy a full dinner at the finest house in town for anyone who reports this sentence to me."  It was months before he had a taker.  Unfortunately the one who caught it was his boss, who was not amused.  Made paying for the dinner problematic.
