Forced to leave Thailand in about 7 days!
« on: December 11, 2016, 05:28:19 pm »
Hi all!

A friend of mine is forced to leave Thailand in about 7 days, after 15+ years, because his employer decided to pull out of Asia.

The immigration laws in Thailand are insane, they force you to leave the country within two weeks if you can't find a new job.  :palm:

He have been working legally and paying taxes for many many years, and now he will be forced to leave almost everything behind (loved ones, friends, habits, etc), very sad...

Right now he is desperately looking for a new work, but it is not easy. But, what else can he do? What other options does he have? Can anyone help in any way? Any tips or ideas are welcome, thanks.

Kind Regards,
Javier.

PS: I don't know if this is the right place to post this. If not, please move it, sorry.
My English can be pretty bad, so suggestions are welcome. ;)

So why it is the gov't's fault? If someone has worked in a foreign country for 15 years, he should consider a green card or even immigration, after all it is almost his second hometown.
because it is asocial and unfair?

Just go to Cambodia, get a tourist visa, return and find a job.  Then go back to Cambodia to arrange for work permits etc.  Siem Reap is a nice (and very inexpensive) place to spend time with lots of expats from all over the world.

I have a friend who lived in Panang, Malaysia for many years who would take a trip to Thailand to renew her visa every six months or so.  She did this for 10-20 years (not sure exactly how long).  Her husband owned a restaurant she worked at, but being a foreigner she could never get residency or a work permit and had to do the tourist visa dance indefinitely.

I knew someone who also did this visa dance with Thailand.  Seems crazy, but it seems to work.

If I remember right the person has to write and speak Thai, give up their own country citizenship, pass a written test in Thai and give up their first born.  I think I read about 25 a year do this.  Not like the US where all you have to do is cross the border.

That's the governments' goal. To create unfairness and let its citizens live better, and having a functioning boarder.
The immigration service's job is to let permanent or long term workers to work like it is their home, and let opportunity finder being a loser from another country to f* off.
i'm glad that's not that much the case here in germany. i want to live in an open community that gives people with less luck/abilities a chance. there's always some parasites, but that's normally a minority. most people have an inner motor that drives them to become independent again.

Australia only allows 28 days IIRC after your work VISA expires.

After 15 years he should have applied for permanent residency then if those thing were important to him?
Surely he knew his residency was a) temporary, and b)dependent upon his employment? Yet still decided to ride it for 15 years thinking he'll never lose his job?

Maybe it was so strict, but not now. http://www.thaiembassy.com/thailand/thai-permanent-residency.php

Seems doable but my guess the 100 max a year is a real pisser.  Wished the US had a limit even if it was 1,000,000 a year

NZ is technically zero days, but they give 28 days grace as well.  Unless you are an ozzie bludger. they can stay here for as long as they like and we'll even pay them a benefit.     Tahts beucase we love our ozzie cousins.

@everyone:

First of all, thank you all for your advices!
I have provided him a link to this post, however I'm still waiting for a reply. I guess because of his current situation he must be very busy trying to solve the problem. But I hope he has read this post and we have some news soon.

Thanks again to everyone.  :-+

I have no idea, I asked myself the same questions, but I can not give you an answer yet, because I'm waiting for an answer.

For this question I can give you a reply right now:
Up to a maximum of 2 months with a minimum of 28 days, at least. Proportional to the time worked in that country (for example). To me two weeks seems like a very short time. Do you really think that two weeks is enough?

Here , there are strange things.

First, according his friend, if he has worked for 15 years , Why doesn't he  request the permanent resident? What had he kind visa ?   student visa?

Second, if he has girlfriend and friends.  Anybody of his friends and  girlfriend family's could hire  for a few months?

Third , Is he inscribed to Spanish Ambassory on Tailand? And has he requested help to spanish ambassory?

That's the same method that use the illegal spaniards on Brasil, when their visa little for expiring . They travel to Paraguay border's , they cross the bridge between Brasil-Paraguay and they return the same day.

This is Thailand we are talking about. Few countries are easier to hack in term of visa stays.

Tens of thousand of entrepeneurs/freelancers/lazy hippies live in Thailand permanently with no job contract... probably more than any other country in the world.

From top of my head...

1) As already mentioned, visa run to Phnom Penh (Siem Riep not enough as far as I know) This buys you 6 extra months, and you can repeat again and again forever. I met people who had been doing it for more than a decade. Perfectly legal too.

2) How old is he? Look into retirement visa. If you meet the age requirements, the financial requirements are quite doable, just have some cash in the bank and they give you a permanent visa for the rest of your life.

3) Just get one of those "student visas". Wont endorse illegal stuff in the forum, but your friend should know what it means. Actually I admire the inventiveness of thai people, it's quite a hack on the visa system.

4)
5)
I can think of at least two aditional obvious solutions, but again this is my second post so won't start speaking about illegal stuff.

This smells funny though... I know all this after staying there for 1 year.. your friend cannot figure a solution out after all that time living there?

I am on L-1 in the USA. If I would get fired, I'd have to leave the country in 24h. Is that considered fair compared to 2 weeks?

There ARE limits on US immigration.  Here is a report on the current number of applicants on various waiting lists.  It is by no means automatic as "having no limit" would imply.

https://travel.state.gov/content/dam/visas/Statistics/Immigrant-Statistics/WaitingListItem.pdf

If I am wrong, please cite the official USCIS (U.S Citizenship and Immigration Services) documents that prove the contrary.

You now have 60 days, according to the new policy effective on Jan. 17. This affects L1, H1B, E-series non-immigrant workers and EB1~3 immigrant workers.
I believe F1 students have 60 days as well if my memory serves me correctly, and when OPT is applied and granted, another 3 months of unemployed staying in total is allowed.
https://www.federalregister.gov/documents/2016/11/18/2016-27540/retention-of-eb-1-eb-2-and-eb-3-immigrant-workers-and-program-improvements-affecting-high-skilled

I am not a lawyer to understand that in detail, but do you understand 10 days vs 60 days clauses?

If the OP's 'friend' has been there for 15 years - you think he'd get more than 7 days prior warning of collapse from his company?
Don't ask a question if you aren't willing to listen to the answer.

Both 14 and 28 days seem incredibly short to wrap up an entire life and move somewhere else. If people worked and contributed to the local economy, it seems fair to see them off in a decent fashion. Emigration is not something you do on a whim and often takes a bit of organisation and paperwork, i.e. time.

Of course, living somewhere for 15 years might have warranted more action. Taking personal responsibility is required too.

if you don't come back and fill us all in, this thread is doomed to fill up with armchair experts all pontificating to infinity on what he should have done prior to the problem occurring...

If he has enough savings to be able to support himself for awhile, it does sound daft to kick him out of the country: even though he isn't working, he'd sill be contributing to the economy by: buying food, paying the rent, paying taxes on goods etc. On the other hand, if he's begging or is on welfare then it's more understandable.

It absolutely is daft but I wonder why so many of your countrymen didn't have the same view towards all those Poles, Czechs, Slovaks that are working and paying taxes in the UK ...

Careful about what you criticize elsewhere.

I understand that EU countries pretty much don't have a functioning boarder with other EU countries, but countries out of EU have.
And yes, there is a type of visa called tourist visa, and it has a purpose.

i know, it's awesome! i don't have to get  a visa to go to germany, or france, or almost anywhere in europe...
by comparison, it would be insane if you had to get a visa to go to different states inside the US (those are the distances), same with US <-> Canada
but i see your point

Before you wallow in self-righteous smugness, please bear in mind that, on average, one has to earn over roughly £35,000 a year to be a net tax contributor in the UK.
